A Domestic Violence Lawyer Can Help Protect You
Some families are affected by domestic violence. California defines “domestic violence” as abuse perpetrated against a spouse, former spouse, cohabitant or former cohabitant. Domestic violence may be due to drug or alcohol abuse, or it may be due to anger management issues.
Temporary Restraining Orders
Temporary restraining orders are a quick and effective legal option for anyone facing domestic violence. A temporary restraining order is designed to protect the victim against physical, mental, verbal or other abuse. A restraining order can require the abuser to keep at least 100 yards away from the victim, enforceable by arrest, and may exclude a party from a home. It can be obtained on an emergency basis and in a very short period of time by filing a Temporary Restraining Order Form with the court.
After a temporary restraining order is made by the court, there will be a hearing where a judge will decide if the protective order should remain in place. The judge can decide that the restraint should remain in effect for up to three years.
